In order to encourage action by producer organisation, their associations and interbranch organisations to facilitate the adjustment of supply to market requirements, with the exception of action relating to withdrawal from the market, the power to adopt certain acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of measures concerning live plants, beef and veal, pigmeat, sheepmeat and goatmeat, eggs and poultrymeat sectors to improve quality; promote better organisation of production, processing and marketing; facilitate the recording of market price trends; and permit the establishment of short and long-term forecasts on the basis of the means of production used. 

After close examination, the ad hoc working party decided that it would not be advisable to modify this reading of the scope of exclusive jurisdiction in matters of property, or to clarify the point in the text of the Convention, even taking into account the fact that in cases where the property was located in a nonConvention country Article 4 would probably be invoked frequently, and that there were significant differences in the relevant national laws (4 ). 

In the course of February and March 2008 the Government of the Republic of Cyprus submitted eight cases against the Commission before the Court of First Instance as well as eight requests for interim measures, arguing that the text of the procurement notices used in the programme implementation could imply recognition of a public authority other than the government of the Republic of Cyprus and requested the annulment of all procedures based on these notices. 

The Report from the Commission to the Council and the European Parliament on noise operating restrictions at EU Airports7 pointed to the need to clarify in the text of the Directive the allocation of responsibilities and the precise obligations and rights of interested parties during the noise assessment process so as to guarantee that costeffective measures are taken to achieve the noise abatement objectives. 

As there is currently a need to substantively amend this Regulation, as explained in paragraph 2 above, the Commission considers that this is the occasion to use the recasting technique, as described in the Interinstitutional Agreement of 28 November 2001 on a more structured use of the recasting technique for legal acts6 , in order to adopt a single legislative text which simultaneously makes the desired amendments, codifies those amendments with the unchanged provisions of the earlier acts and repeals those acts. 

On the basis of quantitative analysis, government debt and government liabilities were found consistent for all five categories of instruments examined (short- and long-term loans, shortand long-term securities, and currency and deposits5 ) in only four countries: Greece, Spain, Luxembourg and Finland, whereas three countries exhibit inconsistencies for three categories: Ireland, Austria and Sweden. 

In the context of mail delivery, a sector in which DPLP’s USO was mainly financed through stamp prices (3), the Commission considers that it makes a substantial difference in terms of risk whether the stamp prices were, to a greater or lesser degree, frequently adjusted by the regulator (e.g. at the start of each year or simply whenever necessary) so as to cover the net costs of the USO on an ongoing basis, or whether stamp prices (4 ) were fixed in advance for a long period (e.g. four to five years) as part of a long-term contract (1 ). 

At the time of the negotiation of the Agreement, the Scientific and Veterinary Committee of the Commission (3 ) commented that the standards indicated in the text could not be defined as ‘humane’ (as already stressed before), given that the maximum time allowed to render the animal insensible to pain was far beyond the acceptable length (instantaneous death). 

In this context, an important characteristic of the modern knowledge society should be highlighted: contrary to the practice in former times, when, for example, the manufacture of silk was protected by the Chinese as a strict secret, the knowledge that has been attained — our most valuable possession — is offered almost freely (10 ), for example to students from all over the world at universities and technical institutes (even in the form of grants) and also in text books, publications, patent specifications, conferences of experts, internet publications, specialist journals, etc. 

Annex I (Agreement between the European Community and the Republic of Croatia on reciprocal preferential trade concessions for certain wines, referred to in Article 27 (4) of the SAA) to the Additional Protocol adjusting the trade aspects of the SAA, to take account of the outcome of the negotiations between the parties on reciprocal preferential concessions for certain wines, the reciprocal recognition, protection and control of wine names and the reciprocal recognition, protection and control of designations for spirits and aromatised drinks, shall be replaced by the text set out in Annex X to this Protocol. 

Recent EESC opinions cover for instance; citizenship, employment, working conditions, life long learning, social and territorial cohesion, social protection, social exclusion, persons with a disability, gender issues, youth, children's rights, ageing, immigration and integration, environment and sustainable 27.4.2007 C 93/46 development, food safety and consumer protection, communications and transport, tourism services of general interest, public health, obesity and the social consequences of climate change as well as the more comprehensive Lisbon strategy. 

In accordance with the current Schengen acquis, a third-country national holding a national long-stay visa ("D visa") for stays exceeding three months is allowed to stay only in the territory of the Member State which issued the visa and, pursuant to Article 18 of the Convention Implementing the Schengen Agreement (the Schengen Convention)2 as amended by Regulation 1091/20013 is allowed to transit through the territories of the other Member States only in order to reach the State which issued the visa. 

The text of the Euro-Mediterranean Agreement, including the Annexes and Protocols forming an integral part thereof, and the Final Act together with the declarations annexed thereto shall be drawn up in the Bulgarian and Romanian languages (1) and these texts shall be authentic in the same way as the original texts. 

National General Authorisation for industrial goods as defined in the decree of 18 July 2002 concerning the export of industrial goods subject to strategic control in the European Community [as published in the Official Journal of the French Republic No 176 of 30 July 2002 (text 11) and as amended by the decree of 21 June 2004 concerning the enlargement of the European Union as published in the Official Journal of the French Republic of 31 July 2004 (text 5)]. 

Even though this aspect is somewhat mitigated by the specific reference to traffic accidents issues in the Review Clause (Article 30 in the common position), which is intended to give special attention to the issue of traffic accidents in the report on the application of the Regulation in order to evaluate the effects of absence of fully harmonised rules on law applicable on traffic accidents within the Community, the Commission still would have preferred the text proposed in its amended proposal (Article 24(2) of that proposal). 

Pleas in law: breach of Article 8(1)(b) of Regulation (EC) No 207/2009 (1 ) by reason of a misappraisal of the similarity of the opposing marks; failure to have regard for the fact that the trade mark applied for constitutes part of the name of the applicant company, which has been used long before the date of the application, and is a historically well-founded designation distinguishing the applicant; and failure to take account of the long-lasting and peaceful co-existence of the trade mark applied for and the trade marks cited in opposition. 

When defining the adjustment path to the medium-term budgetary objective for Member States that have not yet reached this objective and in allowing a temporary deviation from this objective for Member States that have already reached it, under the condition that an appropriate safety margin with respect to the deficit reference value is preserved and that the budgetary position is expected to return to the medium-term budgetary objective within the programme period, the Council shall take into account the implementation of major structural reforms which have direct long-term costsaving effects, including by raising potential growth, and therefore a verifiable impact on the long-term sustainability of public finances. 

Regulatory authorities should provide information to the market also to permit the Commission to exercise its role of observing and monitoring the European gas market and its short, medium and long term evolution, including aspects such as supply and demand, transmission and distribution infrastructures, cross-border trade, investments, wholesale and consumers prices, market liquidity, environmental and efficiency improvements. 

With regard to the holders of long stay visas and residence permits, the Schengen acquis only states the principle of the equivalence between a long stay visa/residence permit and a short stay visa24 : according to this principle, the holder of a long stay visa or residence permit issued by a Schengen state is entitled to travel to the other Schengen states for short stay, if they meet the entry conditions, i.e. if they are in possession of a valid travel document; justify the purpose and conditions of the intended stay and have sufficient means of subsistence; are not a person for whom an alert has been issued in the SIS for the purpose of refusing entry; and are not considered to be a threat to public policy, internal security, public health or the international relations of any of the Member States25 .
